Introduction and Agreement

These Student Terms and Conditions govern your enrolment and participation in courses offered by Nexsy Academy Ltd, a private training provider specialising in digital skills, business process optimisation, and artificial intelligence education. By enrolling in any of our courses, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

These Terms form a legally binding contract between you (the student) and Nexsy Academy Ltd. Please read them carefully in conjunction with our Privacy Policy and Payment Terms and Conditions, as these documents collectively govern your relationship with us throughout your learning journey.

Definitions and Interpretation

For the purposes of these Terms;

"Academy" refers to Nexsy Academy Ltd.

"Student" or "you" means the person enrolling in our courses.

"Course" encompasses all educational programmes, modules, and services we provide

"LMS" refers to the Learning Management System provided by Nexsy Ltd that we utilise for course delivery.

"Instructor" means our qualified teaching staff and industry professionals, and

"Assessment" includes all forms of evaluation, including assignments, practical demonstrations, and examinations.

​

"Live Sessions" refer to real-time interactive classes conducted via video conferencing platforms

​

"Course Materials" encompass all educational resources provided through our LMS, including videos, documents, assignments, and assessment criteria, and

​

"Qualification" means any certificate, diploma, or accreditation awarded upon successful completion of a course.

 

Eligibility and Enrolment Requirements

To enrol in our courses, you must be at least 18 years of age at the time of enrolment, possess the legal capacity to enter into contracts, have access to reliable internet connection and appropriate technology for online learning, meet any specific prerequisites or entry requirements for your chosen course, and be able to participate actively in both live sessions and online learning components.

If you are enrolling on behalf of an organisation or as part of employer-sponsored training, you warrant that you have the necessary authority to commit that organisation to these Terms and any associated payment obligations.

For courses leading to regulated qualifications, additional eligibility criteria may apply as determined by the relevant awarding organisation. We reserve the right to assess your suitability for specific programmes through interviews, skills assessments, or review of prior qualifications where appropriate.

 

Course Structure and Delivery Methods

Our courses combine multiple delivery methods to optimise learning outcomes and accommodate diverse learning preferences. Live interactive sessions are conducted by qualified instructors via professional video conferencing platforms, providing real-time instruction, discussion, and immediate feedback. These sessions are scheduled at predetermined times, and attendance is expected as part of your commitment to the learning process.

The Learning Management System serves as your primary access point for course materials, assignments, assessment submissions, and progress tracking. Through the LMS, you will have access to comprehensive resources, including video tutorials, reading materials, practical exercises, and assessment briefs. The platform also facilitates communication with instructors and fellow students outside of live session times.

Assessment methods vary by course but typically include practical demonstrations conducted via video conferencing, written assignments submitted through the LMS, project-based work demonstrating real-world application of skills, and potentially formal examinations depending on qualification requirements. All assessments are designed to evaluate both theoretical understanding and practical competency relevant to current industry standards.

Student Responsibilities and Expectations

As a student, you are expected to attend all scheduled live sessions punctually and participate actively in discussions and practical exercises. Regular engagement with course materials through the LMS is essential for maintaining progress and achieving learning outcomes. You must complete and submit all assignments by the specified deadlines and participate honestly in all assessment activities.

Technical requirements include maintaining reliable internet connectivity suitable for video conferencing, ensuring you have access to necessary software and hardware as specified for your course, keeping your LMS account secure and not sharing login credentials, and promptly reporting any technical difficulties that may affect your learning.

​

Professional conduct is expected throughout your participation in the course. This includes treating instructors and fellow students with respect, contributing constructively to group activities and discussions, maintaining confidentiality regarding other students' personal information or work, and adhering to academic integrity principles in all assessed work.

​

Intellectual Property and Course Materials

All course materials, including but not limited to videos, documents, assignments, assessment criteria, and proprietary content, remain the intellectual property of Nexsy Academy Ltd or are used under appropriate licensing agreements. You are granted a limited, non-exclusive licence to access and use these materials solely for your educational purposes during and immediately following your course completion.

You may not reproduce, distribute, modify, or commercially exploit any course materials without explicit written permission. This prohibition extends to sharing materials with individuals not enrolled in the same course, uploading content to public platforms, or using materials for commercial training purposes.

​

Work you create as part of your course assessments remains your intellectual property, though you grant us permission to use anonymised examples for educational purposes and quality assurance activities. We may also use your work for external verification processes required by awarding organisations.

​

Use of Learning Management System

Your access to the Learning Management System is provided through a licensing agreement between Nexsy Academy Ltd and Nexsy Ltd, a separate software company. While using the LMS, you must comply with both these Terms and the platform's acceptable use policies.

​

You are responsible for maintaining the confidentiality of your LMS login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorised use of your account or any other security breach you become aware of.

​

The LMS incorporates artificial intelligence features designed to enhance your learning experience. These may include personalised content recommendations and intelligent tutoring support. While these AI tools are designed to assist your learning, you should always apply critical thinking and seek clarification from instructors when needed. Please be aware that Nexsy LMS doesn’t allow you to use AI writers and AI content generation within the LMS for any assessment-related activities.

Assessment and Qualification Standards

All assessments are designed to meet the standards required by relevant awarding organisations and industry best practices. Assessment criteria are communicated at the beginning of each course and are available through the LMS throughout your studies.

​

Practical assessments conducted via video conferencing allow you to demonstrate real-world skills in a controlled environment. These sessions are recorded for quality assurance purposes and may be reviewed by internal verifiers, external verifiers, or representatives of the awarding organisation as part of standard quality assurance processes.

​

Academic integrity is fundamental to the value of your qualification. You must ensure all submitted work is your own, properly attribute any sources or assistance received, and avoid plagiarism, AI-generated text or collusion unless specifically permitted as part of group work. Any suspected academic misconduct will be investigated thoroughly and may result in failure of the assessment or removal from the course.

Student Support and Communication

We provide comprehensive support throughout your learning journey through multiple channels. Instructors are available during scheduled office hours and respond to queries submitted through the LMS within two working days. Technical support for LMS-related issues is available during business hours, with emergency support for urgent matters.

​

Academic support includes guidance on study skills, assistance with understanding course content, clarification of assessment requirements, and advice on career development opportunities. We also provide reasonable adjustments for students with disabilities or learning difficulties, working with you to ensure equal access to educational opportunities.

​

Communication preferences can be managed through your LMS profile. We will use the contact information you provide for course-related announcements, assessment feedback, and administrative matters. You are responsible for keeping your contact information up to date and checking communications regularly.

​

Attendance and Engagement Requirements

Regular attendance at live sessions is essential for successful course completion and qualification achievement. While we understand that occasional absences may be unavoidable, consistent non-attendance may affect your ability to meet course requirements and could result in course failure.

If you are unable to attend a scheduled session, please notify your instructor as soon as possible. Where feasible, we may provide recordings of sessions for review, though this cannot fully replace interactive participation. Extended absences due to illness or other severe circumstances should be discussed with our Student Support Team to explore available options.

Engagement with the LMS is monitored to ensure students are accessing materials and maintaining progress. Prolonged periods of inactivity may trigger welfare checks and could affect your ability to complete assessments within required timeframes.

Disciplinary Procedures and Code of Conduct

All students are expected to maintain professional standards of behaviour that create a positive learning environment for everyone. Unacceptable behaviour includes disruption of live sessions, harassment or discrimination against other students or staff, academic dishonesty, misuse of the LMS or other systems, and any conduct that brings the Academy into disrepute.

Minor infractions may be addressed through informal discussions with instructors or student support staff. More serious matters follow a formal disciplinary process that includes investigation of allegations, opportunity for you to respond to concerns, progressive sanctions ranging from warnings to course suspension or termination, and appeal procedures to ensure fair treatment.

​

In cases involving academic misconduct, sanctions may include a requirement to resubmit work, failure of specific assessments, or removal from the course with potential impact on future enrolment eligibility.

​

Data Protection and Privacy

Your personal data is processed in accordance with our Privacy Policy and UK data protection legislation. We collect and use information necessary for course administration, academic record keeping, assessment and qualification processes, communication regarding your studies, and compliance with regulatory requirements.

Data sharing may occur with awarding organisations for qualification purposes, external verifiers for quality assurance, and relevant regulatory bodies where required by law. We maintain appropriate security measures to protect your information and retain data only for as long as necessary for educational and legal purposes.

You have rights regarding your personal data, including access to information we hold about you, correction of inaccurate data, and, in certain circumstances, deletion of your data. These rights are exercised through the procedures outlined in our Privacy Policy.

Health and Safety Considerations

While our courses are delivered primarily online, health and safety remain important considerations. You are responsible for ensuring your study environment is safe and ergonomically appropriate for extended computer use, taking regular breaks during long study sessions, and maintaining good posture and eye care practices.

If you have any medical conditions or disabilities that may affect your ability to participate fully in course activities, please inform our Student Support Team so we can make appropriate and reasonable adjustments. This includes considerations for extended screen time, audio or visual requirements, or any other accommodations needed for equal access to education.

Changes to Courses and Terms

We reserve the right to make reasonable changes to course content, schedules, delivery methods, or these Terms where necessary to maintain educational quality, comply with regulatory requirements, respond to technological changes, or address unforeseen circumstances.

Significant changes that may materially affect your course experience will be communicated with reasonable advance notice. If changes substantially alter the nature of your course, you may be entitled to transfer to an alternative programme or receive a refund in accordance with our Payment Terms and Conditions.

Changes to these Terms will be communicated via email and/or through the LMS, with updates taking effect from the date specified in the communication. Your continued participation in courses after changes take effect constitutes acceptance of the revised Terms.

Limitation of Liability and Disclaimers

To the maximum extent permitted by law, our liability to you for any matters arising from or relating to your course participation is limited to the fees you have paid for the specific course concerned. We are not liable for indirect, consequential, or special damages, including lost profits, business interruption, or career impact.

We do not guarantee specific employment outcomes, salary increases, or career advancement as a result of completing this course. However, our programmes are designed to enhance your professional capabilities and market competitiveness. Individual results depend on numerous factors, including prior experience, market conditions, and personal effort.

​

Technical service availability is subject to maintenance requirements, internet connectivity, and the reliability of third-party services. While we strive to minimise disruptions, we cannot guarantee uninterrupted access to the LMS or other online services.

​

Complaints and Appeals Procedures

We are committed to providing excellent educational services and welcome feedback on your experience. If you have concerns about any aspect of your course, please first raise them with your instructor or our student support team for informal resolution.

​

Formal complaints should be submitted in writing detailing the nature of your concern, relevant dates and circumstances, and the resolution you are seeking. We will thoroughly investigate all complaints and respond within 15 working days. If additional time is needed for complex matters, we will notify you accordingly.

​

Academic appeals regarding assessment decisions must be submitted within 10 working days of receiving results. They should be based on procedural irregularities, new evidence not previously available, or bias in the assessment process. Appeals are reviewed by staff not involved in the original decision-making process.

​

If you remain dissatisfied after our internal processes, you may have the right to complain to relevant external bodies including awarding organisations, the Office of the Independent Adjudicator for Higher Education, or other appropriate regulatory authorities depending on your course type.

​

Termination and Withdrawal

You may withdraw from a course at any time by providing written notice to our Student Support Team. Withdrawal terms and any entitlement to refunds are governed by our Payment Terms and Conditions, which specify different provisions depending on timing and circumstances.

​

We may terminate your enrolment in cases of serious misconduct, persistent non-compliance with these Terms, non-payment of fees after appropriate notice, or where your continued participation significantly disrupts the learning environment for other students.

​

Upon withdrawal or termination, your access to the LMS will be suspended; however, you may retain access to certain materials for a limited period to facilitate a smooth transition or completion of outstanding administrative requirements. Academic records and achievements earned prior to withdrawal remain valid.

​

Force Majeure and Exceptional Circumstances

Neither party shall be liable for delays or failures in performance resulting from circumstances beyond their reasonable control, including natural disasters, government actions, pandemics, technological failures, or other events that make performance impossible or impracticable.

​

In such circumstances, we will make reasonable efforts to continue course delivery through alternative methods, adjust schedules to accommodate disruptions, communicate regularly about service impacts, and minimise the effect on your educational progress where possible.

​

Extended force majeure events that substantially prevent course delivery may result in course postponement, transfer to alternative delivery methods, or, in exceptional cases, refunds in accordance with our Payment Terms and Conditions.

​

Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, and any disputes arising from or relating to your course participation or these Terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

​

For students residing in Scotland or Northern Ireland, local consumer protection laws may provide additional rights that cannot be excluded by these Terms, and such rights remain fully in effect.

​

Severability and Entire Agreement

If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will continue in full force and effect. Any unenforceable provision will be modified to the minimum extent necessary to make it enforceable whilst preserving its original intent.

​

These Terms, together with our Privacy Policy and Payment Terms and Conditions, constitute the entire agreement between you and Nexsy Academy Ltd regarding your course participation. They supersede all prior negotiations, representations, or agreements relating to this subject matter.
